Acceso a la justicia constitucional en Honduras entre 2010 y 2020 : una alternativa desde la perspectiva del antiformalismo jurídico articulado con una teoría crítica de derechos humanos

Resumen
El presente trabajo aborda la situación de la justicia constitucional en Honduras durante el siglo
XXI, periodo que se ha visto marcado por una serie de avances y retrocesos, todo ello en medio
de una profunda crisis democrática que continuamente debilita el Estado de Derecho y que en
consecuencia amenaza la efectiva garantía de los derechos humanos.
A través de una revisión crítica sobre el acceso a la justicia constitucional, se propone analizar
su efectividad como herramienta de protección de los derechos humanos, especialmente a través
de la figura del amparo, considerado como el recurso idóneo para la tutela judicial efectiva de
estos.
De esta manera se contrasta la mirada positivista que es hegemónica en el Derecho con los
aportes propios de dos perspectivas (antiformalismo jurídico y teoría crítica) que aun siendo
distintas demuestran tener varios puntos en común y que abogan por recuperar el potencial
emancipador del Derecho.
