Resumen
En la investigación biomédica tradicional el empleo de muestras biológicas y sus
datos asociados es establecido en el consentimiento informado específico para
un propósito definido. No obstante, el material biológico puede ser aprovechado
de forma secundaria en múltiples investigaciones futuras, lo cual ha llevado a la
conformación de los biobancos. Estos funcionan como plataformas de apoyo a la
investigación especializada en la obtención, procesamiento, almacenamiento y
distribución de muestras biológicas humanas y sus datos asociados, con el
propósito de ponerlas a disposición de la comunidad científica. En relación con
la problemática expuesta es necesario hacer una reflexión crítica desde bioética
sobre el aprovechamiento secundario de las muestras y datos, ya sea en
biobancos o en colecciones previamente recolectadas, para el bien común y las
vías que garanticen la protección de los donantes o sujetos fuentes.
El Centro de Investigación en Hematología y Trastornos Afines (CIHATA) de la
Universidad de Costa Rica maneja una gran cantidad de muestras biológicas.
Por esta razón, este trabajo de pasantía busca establecer directrices bioéticas
para el aprovechamiento secundario de estas muestras biológicas y datos
asociados en la investigación biomédica en el CIHATA. El proceso metodológico
incluyó la descripción de las colecciones de material biológico, análisis de
normativas nacionales e internacionales, aplicación de cuestionarios a miembros
de los comités éticos científicos y el análisis reflexivo para el desarrollo de pautas
bioéticas. Las pautas, basadas en la ética de la investigación, así como en
principios éticos internacionales, enfatizan el respeto a la dignidad humana, del
cual deriva el respeto a la autonomía y a la privacidad como principios básicos
que permiten a las personas controlar el uso de sus muestras y datos biológicos.
Además, las pautas elaboradas destacan la necesidad de promover la
participación y la formación en este tema, con el fin de alcanzar consensos y
nuevos juicios morales que contribuyan al progreso de las investigaciones
biomédicas en el país.
