Derechos humanos en la sociedad fronteriza del territorio norte-norte: protección en la legislación costarricense

Resumen
El resguardo de los derechos humanos fundamentales es clave para la vida democrática, la paz y la justicia social de las naciones. Costa Rica se precia en el mundo por la solidez de su estado social de derecho y la protección que les otorga a sus residentes, sean nacionales o personas extranjeras. No obstante, en el caso de la sociedad fronteriza de la zona norte-norte del país, se encuentran grupos poblacionales vulnerados desde diversos flancos (migración, pobreza, barreras simbólicas, baja escolaridad), que ven opacada la vivencia plena de sus derechos. A luz de la legislación nacional e internacional, este texto describe parte del marco jurídico garante de derechos como salud, educación y trabajo para los individuos que residen en la sociedad fronteriza en contraste con los principales desafíos que se tienen para su cumplimiento.
The protection of fundamental human rights is key to the democratic life, peace, and social justice of nations. Costa Rica prides itself all over the world for the strength of its social rule of law and the protection it grants to its residents, whether nationals or foreigners. However, in the case of the border society in the north-north of the country, there are vulnerable population groups from various sides (migration, poverty, symbolic barriers, low schooling) that see their full experience of rights overshadowed. Considering national and international legislation, this text reflects on the legal framework that guarantees rights, such as health, education and work for individuals residing in the border society, contrasting it with the main challenges for its compliance.
