Aduanas Verdes: Lecciones Aprendidas, 2012-2016

Abstract

Como producto de la globalización, el Comercio Internacional no solo se circunscribe a intercambios de bienes y servicios, actualmente involucra temas esenciales para la sociedad: Medio Ambiente y Salud Humana. Como consecuencia de esto, los organismos internacionales competentes han creado las Aduanas Verdes, desarrollando departamento gestores en las Aduanas, cuyo rol es velar por el cumplimiento y buena aplicación de los Acuerdos Multilaterales Medio Ambientales (AMUMAs). En República Dominicana, busca reforzar la vigilancia del comercio ambiental, fortalecer las normativas y regulaciones internacionales, así como la correcta aplicación de las leyes nacionales de los Ministerios. Destacándose como puntos focales de los AMUMAs, los Convenios de: Basilea, Rotterdam, Estocolmo, Cites, Protocolo de Montreal, Cartagena, Convenio de Armas Químicas y la Resolución 1540. El propósito de esta evaluación, es determinar, si Aduanas Verdes en la DGA, cuenta con la capacidad requerida para consolidarse como departamento en su estructura organizacional. La metodología de investigación utilizada fue la descriptiva, sustentada en consultas bibliográficas y datos virtuales. Como técnicas de investigación: la documental y de campo, basada en cuestionarios y entrevistas realizados a personas especializadas en el tema. Como resultado de la investigación, se determinó que en la DGA no se cumplen totalmente las directrices de los AMUMAs, por la debilidad de no contar con una estructura sólida. Así mismo, se identificó que las acciones realizadas por AV pueden garantizar su sostenibilidad en el tiempo. Igualmente, fueron identificadas razones por las que el país podría hacer de AV un modelo replicable para la Región del Caribe y Latinoamérica.

As a result of globalization, the international trade goes beyond the exchange of goods and services; it currently involves essential topics to the Society: the Environment and the Human Health. As a consequence of this, the relevant international organizations have created the Green Customs, developing these departments inside Customs, whose main role is to ensure the correct application and implementation of the Multilateral Environmental Agreements (MEAs). In the Dominican Republic, it seeks to reinforce the surveillance of the environmental trade, to strengthen the international policies and regulations, as well as the correct application of the national laws within the Ministries. In this regards and as focal point of the MEAs, we have the following Conventions: Basel, Stockholm, Cites, Rotterdam, Montreal Protocol, Cartagena, and the National Law 1540. The purpose of this evaluation is to determine, if Green Customs in the DGA, has the capacity required to be consolidated as an independent Department within the organizational structure of the DGA. The research methodology used was descriptive, based on bibliographical and online consultations. As research techniques: the documentary and field investigations where used, based on questionnaires and interviews made experts in the subject. As a result of the research, it was determined that the guidelines of MEAs are not being fully met by the DGA due to the weakness of not having a solid structure. On the other hand, it was identified that the actions carried out by AV can guarantee their sustainability over time. Also, the reasons for which the Dominican Republic could make AV a model that can be repeated in other countries of the Caribbean Region and Latin American. Were identified.
