Resumen
Se pretende con este estudio, analizar el fundamento y la efectividad de las labores desempeñadas por el funcionario consular honorario, tomando en cuenta la imperiosa necesidad existente de formar un método o sistema que dirija a las personas interesadas en ejercer esta actividad, como un complemento de su ocupación diaria.
Fue necesario iniciar el estudio, analizando la Institución Consular en su totalidad, tomando en cuenta la evolución histórica, los intentos de codificación del derecho consular, el establecimiento de relaciones consulares, las personas que forman parte de la oficina consular, el tipo de funciones que desempeñan, de cuales inmunidades y privilegios gozan, cuando finalizan sus funciones y entre estos temas también se trata en un capítulo aparte lo referente a la Institución Consular Honoraria.
Se da énfasis a la clasificación consular destacando el tipo de nombramiento que según las leyes consulares nacionales puede hacerse a un funcionario consular honorario, sin dejar de lado lo que estipula la Convención de Viena sobre Relaciones Consulares de 1963.
Al revisar detenidamente lo que es la institución consular honoraria, nos detenemos en el tipo de función que el funcionario consular honorario está llamado a desempeñar y también se establece su similitud con la función que desempeña el Cónsul remunerado, destacando el grado de responsabilidad que adquiere un funcionario consular honorario al comprometerse a desempeñar sus labores consulares en nombre de un Estado.
Las inmunidades y los privilegios incluyen todas las implicaciones que en materia de facilidades se permiten a un funcionario consular, advirtiendo cuales de ellas son válidas para el funcionario consular honorario y el por qué.
El estudio continúa explicando como se da el cese de funciones consulares y analiza cuales son las razones por las cuales se da la terminación de las relaciones consulares.
Al final del trabajo se adjunta un reglamento con sus normas ajustables al desempeño de funciones consulares por parte del cónsul honorario, pretendiendo mayor seriedad y formalismo en su elección.
The purpose of this study is to analyze the basis and effectiveness of the work performed by the honorary consular officer, taking into account the imperative need to form a method or system to guide people interested in exercising this activity, as a complement to their daily occupation. It was necessary to begin the study by analyzing the Consular Institution in its entirety, taking into account the historical evolution, the attempts to codify consular law, the establishment of consular relations, the persons who form part of the consular office, the type of functions they perform, the immunities and privileges they enjoy, when their functions end, and among these topics, the Honorary Consular Institution is also dealt with in a separate chapter. Emphasis is given to the consular classification highlighting the type of appointment that according to the national consular laws can be made to an honorary consular officer, without leaving aside what is stipulated in the Vienna Convention on Consular Relations of 1963.In reviewing in detail what the honorary consular institution is, we dwell on the type of function that the honorary consular officer is called upon to perform and also establish its similarity with the function performed by the paid Consul, highlighting the degree of responsibility that an honorary consular officer acquires when committing to perform his consular duties on behalf of a State. Immunities and privileges include all the implications of the facilities allowed to a consular officer, noting which of them are valid for the honorary consular officer and why. The study goes on to explain how consular functions are terminated and analyzes the reasons for the termination of consular relations. At the end of the work, a regulation is attached with its rules that can be adjusted to the performance of consular functions by the honorary consul, aiming at greater seriousness and formality in his election.
