Logística inversa y su impacto en el cumplimiento de la ley para la gestión integral de residuos en Costa Rica

Resumen
El concepto de logística inversa es aún inexplorado por muchas
empresas y por ende, se desconocen también los beneficios que pueden
obtener de la aplicación de éste concepto dentro de sus operaciones;
esto aunado a las nuevas responsabilidades empresariales que nacen a
raíz de la nueva ley 8839 (Ley de gestión integral de residuos sólidos en
Costa Rica) brindan una buena oportunidad para que las empresas
empiecen a averiguar cómo la implementación de la logística inversa
puede proveerles beneficios, ventajas, rentabilidad y competitividad
dentro de un mercado cada vez más exigente.
La Ley 8839 tiene por objeto regular la gestión integral de
residuos y el uso eficiente de los recursos, mediante la planificación y
ejecución de acciones regulatorias, operativas, financieras,
administrativas, educativas, ambientales y saludables de monitoreo y
evaluación1
, sentando las bases en temas de regulación y control de
desechos en el país y, con ello nuevas responsabilidades que involucran
a la sociedad.
Además la ley 8839 juega un papel importante, generando una
contribución e impacto positivo, ya que salen a relucir las
responsabilidades de los individuos y de las empresas en el control de
residuos, en el manejo responsable de desechos y en la mitigación o
reducción de la contaminación; sin embargo aún faltan algunos
elementos normativos y administrativos expuestos en el presente
trabajo para que dicha ley pueda ser efectiva a nuestra consideración.
Es por ello que surge el interés de mostrar mediante el presente
artículo, cómo la logística inversa se relaciona directamente con el tema
de control de residuos, como su implementación puede contribuir a las
empresas en el área legal, económica, social y ambiental y como las
empresas se pueden beneficiar con la logística inversa.
The concept of reverse logistics is still unknown by many companies and for this reason, they also do not know about the benefits they can get from the application of this in their operations, and this coupled with new business responsibilities that arise as a result of the new Law 8839 (Law of integrated solid waste management in Costa Rica) and that provide a good opportunity for companies to begin finding out how the implementation of reverse logistics may provide benefits, advantages, profitability and competitiveness in an increasingly demanding market. The Law 8839 has been created in order to regulate the management of waste and efficient use of resources, through planning and implementation of regulatory actions, operational, financial, administrative, educational, environmental and health monitoring and evaluation [1], laying on the country basis for the issue of regulation and control of wastes, and with this are born the new responsibilities that involve the entire society. Besides, the positive impact and contribution of the 8839 law plays a very important role, since it comes to light the responsibilities of all individuals and companies in the waste control, waste management and responsible for mitigating or reducing the pollution, but there are still some regulatory and administrative elements presented in this work for this law takes effect. Therefore, there is an interest of showing, how reverse logistics is directly related to the issue of waste control, and its implementation can help companies in the legal, economic, social and environmental as companies can get benefits from reverse logistics.
