Análisis del modelo de gestión del Plan de Acción 2022-2026 de la Política Pública de Justicia Juvenil Restaurativa en Costa Rica

Resumen
El presente Trabajo Final de Graduación analiza el modelo de gestión del Plan de Acción 2022-2026 de la Política Pública de Justicia Juvenil Restaurativa en Costa Rica, con el objetivo de proponer un fortalecimiento que optimice la coordinación interinstitucional y el seguimiento de los compromisos asumidos. A través de una metodología cualitativa basada en la observación participante, revisión documental y entrevistas a actores clave, se identifican avances en el Poder Judicial mediante la labor de la ORJR y la Dirección de Planificación, así como vacíos en el Poder Ejecutivo, donde persiste la falta de una instancia rectora con competencias claras. Esta situación ha generado debilidades en la articulación institucional y sostenibilidad del proceso. La investigación culmina con una propuesta estructurada en tres ejes estratégicos orientada a consolidar una gestión más efectiva y sostenible, destacando la relevancia de la justicia restaurativa como instrumento clave para la reinserción social de personas jóvenes en conflicto con la ley.
This Final Graduation Project analyzes the management model of the 2022–2026 Action Plan of the Public Policy on Restorative Juvenile Justice in Costa Rica, with the aim of proposing a strengthening strategy to improve inter-institutional coordination and the monitoring of agreed commitments. Using a qualitative methodology based on participant observation, document review, and semi-structured interviews with key stakeholders, the study identifies significant progress within the Judiciary, particularly through the work of the ORJR and the Planning Directorate, while highlighting the absence of a clear governing body within the Executive Branch. This institutional gap has led to coordination challenges, fragmented responsibilities, and an overreliance on the political will of current administrations. The research concludes with a proposal structured around three strategic pillars to promote a more effective and sustainable management model, underscoring the relevance of restorative justice as a key mechanism for the social reintegration of young people in conflict with the law.
