Resumen
La peritación topográfica con fines judiciales, es una especialidad del ejercicio profesional de la topografía que tiene una fuerte relación con la administración de justicia. En este trabajo se seleccionaron y adecuaron conceptos legales técnicas topográficas y aspectos de normalización.
El concepto general del trabajo escrito lo componen dos partes. La primera presenta los elementos necesarios para la elaboración de un peritaje topográfico, tal como el fundamento conceptual jurídico, los planeamientos de orden teórico y técnico provenientes de la topografía y, los conceptos sobre aseguramiento de la calidad. La segunda parte es una herramienta concreta sobre la forma de elaborar peritajes topográficos con carácter forense.
Se establece una relación entre la doctrina legal, fundamento de todo el sistema pericial y las labores topográficas con fines forenses. Entre los temas tratados están los conceptos de prueba jurídica y prueba parcial, las características jurídicas del peritaje, la validez del peritaje y la ejecución del peritaje. Se incluye un repaso al código procesal penal, en los aspectos relacionados a la solicitud y ejecución de pruebas peritales. Dentro de este tema se incluye un análisis de las condiciones requisitos del perito y del peritaje; y su función dentro del sistema de administración de justicia.
The topographic survey for judicial purposes is a specialty of the professional practice of topography that has a strong relationship with the administration of justice. In this work, legal concepts, topographical techniques and aspects of normalization were selected and adapted. The general concept of written work is made up of two parts. The first presents the necessary elements for the elaboration of a topographic survey, such as the legal conceptual basis, the theoretical and technical planning from the topography and the concepts of quality assurance. The second part is a specific tool on how to prepare topographic surveys with a forensic nature. A relationship is established between legal doctrine, the foundation of the entire expert system, and topographical work for forensic purposes. Among the topics covered are the concepts of legal evidence and partial evidence, the legal characteristics of the expert opinion, the validity of the expert opinion and the execution of the expert opinion. A review of the criminal procedure code is included, in aspects related to the request and execution of expert evidence. Within this topic an analysis of the conditions requirements of the expert and the expert opinion is included; and its role within the justice administration system.
