Resumen
El problema que se abordó en esta investigación consiste en que actualmente a la
cláusula 238 del Acuerdo de Asociación Económica (EPA por sus siglas en inglés),
sobre Preferencias Regionales no ha sido aplicado correctamente dentro de los países
que conforman la región del CARIFORO. Según indica, cualquier trato más favorable
que un Estado signatario del CARIFORO pueda conceder en virtud del acuerdo a la
Parte, también será aplicado a cada uno de los Estados signatarios del CARIFORO, en
vista de esto los países que conforman el CARICOM aplican las preferencias o ventajas
entre ellos, pero no entre los países del CARIFORO del cual la República Dominicana
forma parte.
En consecuencia, el propósito de esta investigación consistió en analizar cuál fue el
proceso de negociación de las Preferencias Regionales dentro del Acuerdo de
Asociación Económica, las inclusiones y exclusiones dentro de estas, y examinar cómo
ha sido el desempeño de la República Dominicana en este artículo, para de esta forma
determinar los desafíos pendientes que existen para el país.
La metodología de investigación utilizada fue de naturaleza descriptiva y analítica. Los
métodos utilizados fueron el analítico y deductivo. Dentro de las técnicas de
investigación que se utilizaron, están la documental y la de campo, basada en entrevistas
que contienen un cuestionario base.
Como resultado de la investigación se determinó que la Negociación de la República
Dominicana de las Preferencias Regionales dentro EPA, fue inducida por la Unión
Europea, a la cual el equipo negociador accedió con la intención de las partes
involucradas en este proceso como grupo de países menos desarrollados le estamos
dando una preferencia a un país desarrollado, también nos lo demos entre nosotros
mismos a los fines de fortalecer la integración regional en los países.
Por otro lado, se comprobó que de lo ejecutado al día de hoy dentro de lo que negociado
en el Acuerdo, los avances no han sido tan significativos, se conformó un grupo de
trabajo en el marco del acuerdo, pero no se le ha dado la debida aplicación de parte de
los países del CARICOM, no por falta de dejadez institucional dominicana.
Así mismo, la investigación arrojó que la República Dominicana enfrenta diversos

Económica, como la voluntad política de la región, la estabilización de un dialogo
moderado entre ambas partes, entre otras.
The problem addressed in this research is currently the 238 clause of the Economic Partnership Agreement, on regional preferences, that has not been properly implemented within the countries of the CARIFORUM region. This indicated that any more favorably treatment than a signatory form the CARIFORUM may be granted under the agreement to the Party, also be applied to each of the Signatory CARIFORUM States, given that the countries of the CARICOM apply preferences or advantages including, but not between CARIFORUM countries which form part of the Dominican Republic. Accordingly, the purpose of this research was to analyze what was the negotiation of regional preferences within the EPA, inclusions and exclusions within these, and consider how it has been the performance of the Dominican Republic in this article, to thereby determine the remaining challenges that exist for the country. The research methodology used was descriptive and analytical nature. The methods used were analytical and deductive. Within the investigative techniques that were used, they are the documentary and field, based on a questionnaire containing interviews base. As a result of the investigation it was determined that the negotiation of the Dominican Republic Regional Preferences in EPA was induced by the European Union, to which the negotiating team agreed with the intent of the parties involved in this process as a group of countries less developed were giving preference to a developed country, we also give among ourselves in order to strengthen regional integration in the countries. Furthermore, it was found that of the executed today in what was negotiated in the Agreement, progress has not been as significant, a working group under the agreement was formed, but has not been given the proper implementation of part of the CARICOM countries, not for lack of Dominican institutional neglect. Also, the investigation showed that the Dominican Republic faces several challenges to regional preferences within the EPA, as the political will of the region, stabilization of a moderate dialogue between both parties, among others.
