Propuesta estratégica para promover la garantía y defensa de los derechos de la Niñez y Adolescencia en el cantón de Atenas, 2014-2015

Abstract

El presente trabajo investigativo surge la necesidad de conocer el estado actual en que se encuentran los derechos de las personas menores de edad en el cantón de Atenas, así como el papel que han desempeñado los diferentes actores sociales de la localidad para garantizar el cumplimiento de estos; por ello, la investigación se titula “Propuesta estratégica para promover la garantía y defensa de los derechos de la Niñez y Adolescencia en el cantón de Atenas, 2014-2015”. Dado que, en Costa Rica, son muchos los elementos políticos y jurídicos existentes que contribuyen al respaldo en el cumplimiento de los derechos de la población menor de edad, es indispensable analizar qué acciones se están realizando al respecto. Por tal motivo, el análisis realizado se centra en determinar cómo podrían los diferentes actores sociales, principalmente las personas menores de edad, promover la garantía y defensa de los derechos de todos los niños, niñas y adolescentes del cantón de Atenas. Por ello, la investigación pretende identificar y definir las competencias de los diferentes actores sociales que promueven la garantía y defensa de los derechos de la población menor de edad, así como lograr describir el estado de cumplimiento en que se encuentran los derechos de las personas menores de edad del cantón de Atenas. Posteriormente, elaborar una propuesta estratégica que contribuya a promover la garantía y defensa de los derechos de las personas menores de edad en el cantón de Atenas. El estudio se realizó por medio de una investigación exploratoria, descriptiva y propositiva, mediante la aplicación de entrevistas a informantes clave y de encuestas a niños, niñas y adolescentes, que, en su totalidad, se aplicaron 376 encuestas; para el logro del análisis requerido, se analizó la información obtenida separando a la población de estudio, según grupos de edad, sexo y distrito de procedencia. Otra de las técnicas utilizadas fue el análisis bibliográfico que contenía información sobre el papel que desempeñan las distintas instituciones del Estado en materia de niñez y adolescencia, así como de los diferentes informes publicados constantemente por ellas mismas (PANI, Municipalidad de Atenas, Ministerio de Salud, entre otros) donde se detalla su actuar. Se concluyó que para que exista una participación auténtica y legítima de las personas menores de edad, debe trascenderse más allá de brindar información a los niños, niñas y adolescentes sobre sus derechos y de realizar actividades sobre cultura, juego y recreación. Esta vinculación debe promover que las personas menores de edad tomen decisiones en los temas que les compete mediante injerencia política, participación ciudadana y fiscalización. El trabajo articulado, eficiente, efectivo y oportuno entre instituciones y organizaciones en materia de niñez y adolescencia, así como de la sociedad civil, especialmente las personas menores de edad, es la forma organizativa más eficaz para promover los derechos de todos los niños, niñas y adolescentes del cantón de Atenas. Como recomendación se estableció que debe generarse un cambio en la forma en que se organizan los diferentes actores sociales del cantón de Atenas que se relacionan con asuntos de niñez y adolescencia, no solo mediante la articulación, comunicación efectiva y construcción de proyectos comunes, sino también para incorporar a las personas de entre 9 y 17 años de edad en los procesos que buscan promover la garantía y defensa de sus derechos y para trabajar de manera integral aquellas situaciones que los violentan. De igual manera, aprovechar los recursos disponibles en las diferentes entidades existentes que enfocan su quehacer en la atención de la niñez y adolescencia para un trabajo en conjunto.This research work arises from the need to know the current status of the rights of minors in the canton of Atenas, as well as the role played by different social actors in the locality to ensure compliance with these rights; therefore, the research is entitled “Strategic proposal to promote the guarantee and defense of the rights of children and adolescents in the canton of Atenas, 2014-2015”. Given that, in Costa Rica, there are many existing political and legal elements that contribute to the support in the fulfillment of the rights of the underage population, it is essential to analyze what actions are being taken in this regard. For this reason, the analysis focuses on determining how the different social actors, mainly minors, could promote the guarantee and defense of the rights of all children and adolescents in the canton of Atenas. Therefore, the research aims to identify and define the competencies of the different social actors that promote the guarantee and defense of the rights of the underage population, as well as to describe the state of fulfillment of the rights of minors in the canton of Atenas. Subsequently, to elaborate a strategic proposal that contributes to promote the guarantee and defense of the rights of minors in the canton of Atenas. The study was carried out by means of an exploratory, descriptive and propositional research, through the application of interviews to key informants and surveys to children and adolescents, which, in total, 376 surveys were applied; in order to achieve the required analysis, the information obtained was analyzed by separating the study population according to age groups, sex and district of origin. Another technique used was the bibliographic analysis containing information on the role played by the different State institutions in the area of children and adolescents, as well as the different reports constantly published by them (PANI, Municipality of Atenas, Ministry of Health, among others) detailing their actions. It was concluded that for there to be an authentic and legitimate participation of minors, it must go beyond providing information to children and adolescents about their rights and carrying out activities on culture, play and recreation. This linkage should promote that minors make decisions on issues that concern them through political interference, citizen participation and oversight. Efficient, effective and timely coordination between institutions and organizations related to children and adolescents, as well as civil society, especially minors, is the most effective organizational form to promote the rights of all children and adolescents in the canton of Atenas. As a recommendation, it was established that a change should be generated in the way in which the different social actors of the Atenas canton that are related to children and adolescent issues are organized, not only through the articulation, effective communication and construction of common projects, but also to incorporate people between 9 and 17 years of age in the processes that seek to promote the guarantee and defense of their rights and to work in a comprehensive manner those situations that violate them. Likewise, to take advantage of the resources available in the different existing entities that focus their work on the care of children and adolescents to work together.
