Resumen
En el presente trabajo de investigación se realiza un análisis sobre cómo ha sido el proceso
de implementación del recurso de apelación dentro de la Corte de Apelaciones Civil de Honduras
de los años 2018 a 2020, lo cual es una innovación en el proceso y ha generado ciertos retos para
los usuarios, jueces y magistrados, deben resolver con mayor celeridad y tener un manejo de este
proceso, pues la mayor parte de este es oral.
Este análisis se lleva a cabo debido a la importancia que ha tenido la implementación de
este proceso, ya que esto ha venido a generar mucha incertidumbre, pues con el Código de
Procedimientos Comunes todo se realizaba de manera escrita, y los recursos se interponían de otra
forma, pero ahora, con este nuevo proceso, se debe analizar más ampliamente la resolución a la
que se está recurriendo y, de igual forma, las audiencias se realizan de forma oral, por lo que es
necesario un estudio más extenso de la legislación, y los jueces y magistrados deben efectuar su
análisis con mayor rapidez.
Toda esta novedad en relación con el proceso ha llevado a que exista mayor celeridad y a
que se pueda impartir justicia de forma pronta y efectiva. Los juicios avanzan de forma más rápida
y mantienen esa particularidad. Esto es fundamental para el manejo del proceso, así como del
conocimiento necesario respecto a este.
El objetivo principal de esta investigación es analizar el proceso de apelación en la
legislación hondureña, a raíz de la implementación del nuevo Código Procesal Civil, en la Corte
de Apelaciones Civil De San Pedro Sula, en el periodo 2018-2020. Como objetivos específicos,
se plantea establecer las características y particularidades de recurso de apelación en la legislación
de Honduras; describir el procedimiento y trámite para la interposición de este recurso de apelación
regulado en el nuevo Código Procesal Civil; identificar la adaptación, por parte de las personas
usuarias, con este nuevo proceso de apelación; y describir las implicaciones sociojurídicas que ha
tenido el nuevo Código Procesal Civil.
El presente estudio posee un enfoque cualitativo, ya que permite recoger información y
crear conocimiento con base en el desarrollo de conceptos. Asimismo, es cualitativo, pues facilita
la recopilación de datos e información de diferentes perspectivas, ya sea de los usuarios que viven
de forma directa este cambio en el proceso de la apelación o de los magistrados de Cortes de
Apelaciones. Entre las principales conclusiones que se obtuvieron, se puede observar que la
apelación de acuerdo con el Código de Procedimientos, y en comparación con el Código Procesal
Civil actual, ha hecho que los usuarios y las personas que imparten justicia se adapten a la nueva
modalidad del proceso, que es la oralidad. Ha sido un poco difícil para ciertos usuarios, sin
embargo, ha llevado a que los procesos sean mas rápidos
In the present research work, an analysis is carried out on how the process has been of implementation of the resource of appeal within the Court of Civil Appeals of Honduras from 2018 to 2020, which is an innovation in the process and has generated certain challenges for users, judges and magistrates, must resolve more quickly and have a management of this process, since most of it is oral. This analysis is carried out due to the importance that the implementation of this process, since this has come to generate a lot of uncertainty, because with the Code of Common Procedures everything was carried out in writing, and the resources were filed in another way form, but now, with this new process, the resolution to the that is being appealed and, likewise, the hearings are held orally, so it is A more extensive study of the legislation is necessary, and the judges and magistrates must carry out their analysis faster. All this novelty in relation to the process has led to greater speed and that justice can be delivered promptly and effectively. Trials move faster and maintain that particularity. This is essential for the management of the process, as well as the necessary knowledge about it. The main objective of this research is to analyze the appeal process in the Honduran legislation, as a result of the implementation of the new Code of Civil Procedure, in the Court of Civil Appeals of San Pedro Sula, in the period 2018-2020. As specific objectives, it is proposed to establish the characteristics and particularities of appeal in the legislation from Honduras; describe the procedure and process for filing this appeal regulated in the new Civil Procedure Code; identify adaptation, by people users, with this new appeal process; and describe the socio-legal implications that had the new Civil Procedure Code. The present study has a qualitative approach, since it allows collecting information and create knowledge based on the development of concepts. Likewise, it is qualitative, since it facilitates the collection of data and information from different perspectives, whether from users who live directly this change in the appeal process or the magistrates of the Courts of appeals. Among the main conclusions obtained, it can be observed that the appeal in accordance with the Code of Procedures, and in comparison with the Code of Procedure Current Civil, has made the users and the people who impart justice adapt to the new modality of the process, which is orality.
