Resumen
Implementación de las Reglas de Bangkok, según el apartado II, correspondiente a categorías especiales Reclusas Condenadas; en el Centro de Atención Institucional Vilma Curling Rivera, ubicado en San Rafael Arriba de Desamparados, San José, Costa Rica, en el año 2020. (Ortega, 2020) El ingreso de las mujeres a los centros penales se ha constituido en un desafío para los Estados e Instituciones que tienen adscritas a esta población, por lo que desde el marco jurídico y la normativa internacional ratificada por cada país se brindan pautas para el abordaje, acorde con a sus necesidades y demandas, debido a esto los recintos penitenciarios están en la obligación de cumplir con lo establecidos en esta normativa; las Reglas de Bangkok se han constituido se constituyen en uno de los reglamentos que indican cuáles son
los procedimientos generales por seguir en el abordaje de las mujeres en prisión o con medidas alternativas; para esta investigación se analizará realizará un análisis el apartado II de esta normativa, correspondiente a reclusas condenadas. Después de una exhaustiva revisión de investigaciones y estudios respecto del tema de las mujeres privadas de libertad, surge el cuestionamiento de analizar la implementación de las Reglas de Bangkok, según el apartado II, correspondiente a categorías especiales

Teniendo como marco referencia el enfoque de derechos humanos y la perspectiva de género, que transversa todo el estudio, además de categorías, como: el control social lo
la cual es vinculante con el proceso de privación de libertad que se ejerce por los Estados para intervenir con todas aquellas personas infractoras de la ley, por lo anterior, se consideró fundamental, evidenciar si en la práctica se están realizando acciones, a lo interno del centro penal, que garanticen los derechos de las mujeres privadas de libertad, según lo establecido en las Reglas. Debido a esto se realizó un análisis del reglamento institucional, así como de las reglas de Bangkok, para comprender cómo desde los lineamientos institucionales se promueven acciones en pro de garantizar el acceso a derechos de las mujeres en condición de prisionalización y el abordaje integral de vulnerabilidad y destrezas; por otra parte se efectúo un acercamiento con los profesionales ubicadas en este recinto, para conocer desde su experiencia como expertos, la implementación de acciones que fomenten los derechos de la población meta, teniendo claros estos dos aspectos, además de la contextualización del centro y su población, se procedió a crear un manual marco de funcionamiento, siendo esta una de las herramientas efectivas para corroborar y favorecer una atención de calidad y así, minimizar los riesgos, en este primer documento se consideraron temas de gran relevancia para promover la garantía de derechos de las mujeres durante su proceso de prisionalización.

(Ortega, 2020) The entry of women into prisons has become a challenge for the States and Institutions that are assigned to this population, so that from the legal framework and the international regulations ratified by each country, guidelines are provided for the approach, according to their needs and demands, due to this, the prisons are obliged to comply with the provisions of these regulations; The Bangkok Rules have become one of the regulations that indicate the general procedures to be followed in the approach to women in prison or with alternative measures; for this research, section II of this regulation, corresponding to sentenced prisoners, will be analyzed. After an exhaustive review of research and studies on the issue of women deprived of their liberty, the question arises of analyzing the implementation of the of the Bangkok Rules, according to section II, corresponding to special categories of sentenced women prisoners; in the Vilma Curling Rivera Institutional Care Center, by the professionals of this institution. Taking as a frame of reference the human rights approach and the gender perspective, which transverses the entire study, in addition to categories such as: social control, which is binding with the process of deprivation of liberty that is exercised by the States to intervene with all those persons who break the law, therefore, it was considered essential to show whether in practice actions are being carried out within the penal center that guarantee the rights of women deprived of liberty, as established in the Rules. For this reason, an analysis of the institutional regulations and the Bangkok Rules was carried out in order to understand how the institutional guidelines promote actions to guarantee access to the rights of women in conditions of incarceration and a comprehensive approach to vulnerability and skills; on the other hand, an approach was made with the professionals located in this precinct, to learn from their experience as experts, the implementation of actions that promote the rights of the target population, having clear these two aspects, in addition to the contextualization of the center and its population, This is one of the effective tools to corroborate and promote quality care and thus minimize risks.
