Resumen
Las medidas no arancelarias son políticas comerciales que podrían potencialmente generar un efecto económico y/o restringir el comercio para proteger sectores productivos nacionales. En ese sentido, los países buscan regular este tipo de medidas a través de acuerdos multilaterales, entre los que puede ser mencionado el Acuerdo sobre Medidas Sanitarias y Fitosanitarias (Acuerdo MSF), el cual busca regular técnicamente la inocuidad y sanidad de los alimentos comercializados.
En el contexto de este Acuerdo, en el año 2013 la República de Haití impone una prohibición de importación a productos avícolas de origen dominicano bajo el alegato de la reaparición de la gripe aviar en la República Dominicana. A pesar de que no existían justificaciones legales ni científicas la medida se mantuvo, afectando al sector avícola dominicano. Por consiguiente, el propósito de la investigación ha sido analizar la situación comercial entre las partes; además, estudiar su impacto para el sectory el proceder de las autoridades involucradas según lo convenido en el Acuerdo MSF.
