Resumen
El Poder Judicial mantiene intensas y complejas relaciones con el sistema político, como parte del esquema de pesos y contrapesos del diseño constitucional que caracteriza a la democracia costarricense. Ello se evidencia en varios aspectos. Un primer contrapeso es el control de constitucionalidad sobre los otros poderes del Estado que ejerce la Sala Constitucional. El análisis de largo plazo encontró que, desde su creación en
1989, esta Sala ha emitido más de 300.000 resoluciones (en promedio 11.700 al año), muchas de ellas sobre asuntos polémicos que han generado amplias discusiones a nivel nacional. Un segundo contrapeso es el
control sobre acciones públicas o privadas que puedan afectar directamente a las y los ciudadanos, mediante recursos de amparo y habeas corpus atendidos por la misma Sala. Los principales hallazgos en esta materia son que una alta proporción de los casos se concentra en pocas áreas (derecho a la pronta resolución, penal, derecho de petición, salud y trabajo) y que cada vez es más frecuente el planteamiento de temas complejos (por ejemplo, unión civil entre personas del mismo sexo) y que son motivo de alta conflictividad social (la pesca de arrastre)...
The Judicial Branch maintains intense and complex relations with the political system, as part of the scheme of weights and counterweights of the constitutional design that characterizes Costa Rican democracy. This is evidenced in several aspects. A first counterweight is the control of constitutionality over the other branches of government exercised by the Constitutional Chamber. A long-term analysis found that, since its creation in 1989, this Chamber has 1989, this Chamber has issued more than 300,000 resolutions (on average 11,700 per year), many of them on controversial issues that have generated broad discussions at the national level. A second counterweight is the control over public or private actions that may directly affect citizens, through writs of amparo and habeas corpus heard by the Chamber itself. The main findings in this area are that a high proportion of the cases are concentrated in a few areas (right to prompt resolution, criminal, right to petition, health and labor) and that complex issues (for example, civil union between persons of the same sex) and which are the cause of high social conflict (trawling) are increasingly frequent....
