Resumen
El proceso de globalización ha generado cambios en las relaciones de los diversos actores en el contexto internacional, entre los cuales
resalta el intercambio comercial, los continuos avances tecnológicos
que han facilitado el desarrollo de pequeñas y medianas empresas, la
presencia cada vez mayor de empresas transnacionales en más países, la
generación de novedosos productos y servicios, y el desarrollo de novedosas técnicas de comercialización cada vez más dinámicas, entre otras.
El actual escenario mundial caracterizado por las relaciones comerciales internacionales ha modificado sustancialmente, no solo la
naturaleza y los procesos de producción y de logística de la mayoría de
las empresas tanto nacionales como internacionales, sino también la
normativa necesaria para regular esas relaciones, debido a que el comercio de las últimas décadas ha evolucionado hacia los bienes de mayor
contenido de conocimiento y creatividad. Por tanto el volumen de bienes afectados por la propiedad intelectual es significativamente creciente.
De igual manera, el consumidor se ha sofisticado, exigiendo de los productores un mayor nivel de investigación, creatividad e innovación, en
términos de calidad y tiempo; razón por la cual la efectiva protección
del contenido inmaterial de valor agregado de un bien es absolutamente necesaria en el comercio de hoy día.
