Resumen
El documento analiza y propone criterios fundamentales para la reforma de la Ley Indígena No. 6172, vigente desde 1977 en Costa Rica. Su propósito es actualizar dicha ley en concordancia con los compromisos internacionales adquiridos por el país, como el Convenio 169 de la OIT, y responder a las profundas desigualdades estructurales que aún afectan a los pueblos indígenas. el documento propone que la reforma a la ley debe contemplar la restitución del derecho a la autodeterminación, el reconocimiento efectivo de los territorios ancestrales, y el respeto a las estructuras políticas, culturales y sociales propias de los pueblos indígenas. También exige que se garantice el derecho a la consulta previa, libre e informada, especialmente en casos de legislación o proyectos que afecten a estos pueblos.
The document analyzes and proposes fundamental criteria for the reform of Indigenous Law No. 6172, in force since 1977 in Costa Rica. Its purpose is to update this law in accordance with the international commitments made by the country, such as ILO Convention 169, and to respond to the profound structural inequalities that still affect indigenous peoples. The document proposes that the reform of the law should include the restoration of the right to self-determination, the effective recognition of ancestral territories, and respect for the political, cultural, and social structures of indigenous peoples. It also demands that the right to free, prior, and informed consultation be guaranteed, especially in cases of legislation or projects that affect these peoples.
