PROYECTO DE LEY DE ACCIONES AFIRMATIVAS A FAVOR DE LAS PERSONAS INDÍGENAS COSTA RICA

Abstract

El Proyecto de Ley de Acciones Afirmativas a favor de las Personas Indígenas en Costa Rica establece una serie de medidas dirigidas a reparar y atender históricas condiciones de desigualdad que han afectado a los pueblos indígenas del país. En primer lugar, declara de interés nacional la implementación de acciones afirmativas, reconociendo la necesidad de garantizar a esta población un trato diferenciado que permita el acceso equitativo a sus derechos fundamentales. Se advierte que el proyecto, tal como está planteado, podría ser insuficiente para responder a la deuda histórica del Estado costarricense con los pueblos indígenas, si no se articula con la legislación internacional ratificada por el país (como el Convenio 169 de la OIT) y con una real participación de las comunidades en la toma de decisiones.

The Affirmative Action Bill for Indigenous Peoples in Costa Rica establishes a series of measures aimed at redressing and addressing historical conditions of inequality that have affected the country's indigenous peoples. First, it declares the implementation of affirmative action to be in the national interest, recognizing the need to guarantee this population differentiated treatment that allows equitable access to their fundamental rights. It should be noted that the bill, as currently drafted, may be insufficient to address the Costa Rican State's historical debt to indigenous peoples if it is not aligned with international legislation ratified by the country (such as ILO Convention 169) and with genuine community participation in decision-making.
