Estudio de línea base como estrategia para la construcción de un plan nacional sobre empresa y derechos humanos de conformidad con la política nacional de responsabilidad social de Costa Rica (2017- 2030) y los principios rectores de las Naciones Unidas sobre las empresas y los derechos humanos

Resumen
Contribuye en el proceso de elaboración de un futuro Plan Nacional sobre Empresa y Derechos Humanos, de conformidad con la Política Nacional de Responsabilidad Social de Costa Rica 2017- 2030 y los Principios Rectores de las Naciones Unidas sobre las Empresas y los Derechos Humanos (PRNU). Como parte del Seminario, se diseña una suerte de estudio preliminar de línea base apoyado en el Kit de Herramientas sobre Planes de Acción de Empresas y Derechos Humanos, diseñada por el Instituto Danés de Derechos Humanos, así como la Herramienta de diagnóstico sobre la implementación de las obligaciones internacionales de derechos humanos en el contexto de la actividad empresarial elaborado por el Instituto Interamericano de Derechos Humanos (IIDH). Ambas herramientas ayudaron a presentar un diagnóstico inicial básico sobre el nivel de implementación en el país de los PRNU, incluidos avances en legislación, políticas públicas y otras disposiciones normativas. Los resultados preliminares que arroja el Seminario han sido presentados como parte de un estudio más amplio que apoyará los esfuerzos del país en el marco del proyecto Conducta Empresarial Responsable en América Latina y el Caribe (CERALC), el cual es liderado por el Ministerio de Economía, Industria y Comercio y otras instancias estatales, con el apoyo de la Organización Internacional del Trabajo (OIT), la Organización para la Cooperación el Desarrollo Económico (OCDE) y la Oficina del Alto Comisionado de las Naciones Unidas para los Derechos Humanos (ACNUDH). El Seminario logra esbozar algunos de los retos más importantes que tiene Costa Rica para asegurar un marco jurídico que proteja los derechos humanos de las personas en el contexto de la actividad empresarial, los cuales deberán ser considerados como parte de un futuro Plan Nacional de Empresas y Derechos Humanos.
Dentro de los principales resultados de esta investigación se destaca alto compromiso del Estado costarricense la adopción de compromisos internacionales tanto vinculantes como no vinculantes, así como los esfuerzos por establecer la protección de los derechos humanos en el marco de la normativa nacional. Sin embargo, es necesario la implementación de mecanismos que faciliten la comunicación entre las autoridades gubernamentales y el sector empresarial, esto con el propósito de mejorar la participación de este sector y que se convierta en un incentivo para la creación de un régimen más
robusto de debida diligencia en materia de derechos humanos.
Contributes to the process of preparing a future National Plan on Business and Human Rights, in accordance with the National Social Responsibility Policy of Costa Rica 2017-2030 and the United Nations Guiding Principles on Business and Human Rights (PRNU) . As part of the Seminar, a sort of preliminary baseline study is designed, supported by the Toolkit on Business Action Plans and Human Rights, designed by the Danish Institute for Human Rights, as well as the Diagnostic Tool on the implementation of international human rights obligations in the context of business activity prepared by the Inter-American Institute of Human Rights (IIDH). Both tools helped to present a basic initial diagnosis on the level of implementation in the country of the UNGPs, including advances in legislation, public policies and other normative provisions. The preliminary results of the Seminar have been presented as part of a broader study that will support the country's efforts within the framework of the Responsible Business Conduct in Latin America and the Caribbean (CERALC) project, which is led by the Ministry of Economy , Industry and Commerce and other state entities, with the support of the International Labor Organization (ILO), the Organization for Economic Cooperation and Development (OECD) and the Office of the United Nations High Commissioner for Human Rights (OHCHR) . The complete study is available and updated as of September 2021 at the following link. The Seminar manages to outline some of the most important challenges that Costa Rica has to ensure a legal framework that protects the human rights of people in the context of business activity, which should be considered as part of a future National Business Plan and Human rights. Among the main results of this investigation, the high commitment of the Costa Rican State stands out in the adoption of both binding and non-binding international commitments, as well as the efforts to establish the protection of human rights within the framework of national regulations. However, it is necessary to implement mechanisms that facilitate communication between government authorities and the business sector, in order to improve the participation of this sector and become an incentive for the creation of a more robust human rights due diligence process.
