ANÁLISIS COMPARATIVO PRELIMINAR DE LA EVOLUCIÓN DE LOS DERECHOS CONSTITUCIONALES FUNDAMENTALES Y LOS DERECHOS ECONÓMICOS, SOCIALES Y CULTURALES DE LOS PUEBLOS AUTÓCNOS EN COSTA RICA Y ECUADOR

Abstract

Este artículo presenta un análisis comparativo preliminar sobre la evolución de los derechos económicos, sociales y culturales (DESC) de los pueblos autóctonos en Costa Rica y Ecuador. Se examina los marcos normativos nacionales e internacionales, como la Declaración Universal de Derechos Humanos y el Convenio 169 de la OIT, así como las respectivas constituciones y legislación ambiental y agraria de ambos países. El estudio se enfoca en tres dimensiones clave: el territorio, los derechos colectivos y el derecho a vivir en un ambiente sano. Se analizan también los desafíos de implementación de políticas públicas, la participación comunitaria, la autodeterminación de los pueblos indígenas y los efectos de las políticas estatales sobre sus condiciones de vida. El artículo incluye datos sociodemográficos, estudios de caso, y una mirada crítica a la institucionalidad encargada de los pueblos indígenas, evidenciando tensiones entre la legislación formal y la realidad de estas comunidades.

This article presents a preliminary comparative analysis of the evolution of the economic, social, and cultural rights (ESCR) of indigenous peoples in Costa Rica and Ecuador. It examines national and international regulatory frameworks, such as the Universal Declaration of Human Rights and ILO Convention 169, as well as the respective constitutions and environmental and agrarian legislation of both countries. The study focuses on three key dimensions: territory, collective rights, and the right to live in a healthy environment. It also analyzes the challenges of implementing public policies, community participation, the self-determination of indigenous peoples, and the effects of state policies on their living conditions. The article includes sociodemographic data, case studies, and a critical look at the institutions responsible for indigenous peoples, highlighting tensions between formal legislation and the reality of these communities.
