La normativa penal del neopentecostalismo en Costa Rica desde una perspectiva de género y derechos humanos

Resumen
El artículo aborda el tema de los crímenes de odio y toda forma de discriminación como
marco general. Como énfasis especifico se orientan los análisis hacia aquellas
violaciones por causa de orientación sexual y de género desde el heterosexismo
religioso, en particular el neopentecostal en Costa Rica. De igual forma, se aborda la
ausencia de leyes y normas que reglamenten estos tipos de comportamientos como
contrarios a derechos protegidos de todo ser humano, como la igualdad de trato y no
discriminación. La primera parte desarrolla las ausencias legales en el Código
Constitucional y Penal sobre crímenes de odio y otras formas de discriminación dirigidas
con personas y grupos LGTBIQ+. La segunda parte analiza, desde los relatos de Adán y
Eva y Sodoma y Gomorra, las bases doctrinales del heterosexismo judeocristiano. La
tercera parte es el resultado operativo del análisis interdisciplinario teológico y jurídico
materializado en el anteproyecto de la “Ley Marco de Prevención y Sanción de
Crímenes de odio y toda forma de discriminación”. Finalmente en el marco general de la
ley se visibiliza las personas y poblaciones afrocostarricenses haciendo la diferencia de
las poblaciones indígenas.
The article addresses the issue of hate crimes and all forms of discrimination as a general framework. As a specific emphasis, the analysis is oriented towards those violations due to sexual orientation and gender from the religious heterosexism, particularly the Neo-Pentecostal in Costa Rica. Likewise, the absence of laws and norms that regulate these types of behaviors as contrary to the protected rights of all human beings such as equal treatment and non-discrimination is addressed. The first part develops the legal absences in the Constitutional and Penal Code on hate crimes and other forms of discrimination directed against LGTBIQ+ persons and groups. The second part analyzes, from the stories of Adam and Eve and Sodom and Gomorrah, the doctrinal bases of Judeo-Christian heterosexism. The third part is the operative result of the interdisciplinary theological and legal analysis materialized in the draft of the "Framework Law for the Prevention and Punishment of Hate Crimes and all forms of discrimination". Finally, in the general framework of the law, the Afro-Costa Rican people and populations are made visible, making a difference with the indigenous populations.
