La violencia simbólica entretejida en la enseñanza del Derecho Penal.

Resumen
Visibiliza la violencia simbólica ejercida sobre el género femenino, a partir del estudio de las relaciones de autoridad y de género que se establecen en el proceso de la enseñanza-aprendizaje del Derecho Penal en la Facultad de Derecho de la Universidad de Costa Rica. Dentro de los objetivos específicos: evidenciar la influencia y la permanencia del sistema patriarcal andrologocéntrico en la enseñanza del Derecho Penal, señalar los estereotipos del “deber ser/hacer” femenino, encontrados en las disposiciones sociales aceptadas entre los estudiantes y profesores, y identificar las manifestaciones, expresiones y formas de la violencia simbólica hacia el género femenino en las relaciones entre profesores y estudiantes de la enseñanza del Derecho Penal. La metodología de investigación tiene un enfoque cualitativo y de género. Se utilizó la técnica de entrevistas de profundidad, y los sujetos de la investigación son los docentes y el estudiantado que imparten o reciben el curso de Derecho Penal. Entre ellos se entrevisto a seis profesores y ocho estudiantes de la carrera de derecho. En el análisis de los datos se utilizó el proceso de los ejes referenciales, compuesta por: palabras claves como indicadores y por tres contextos principales, que son: el derecho penal en la sociedad costarricense, construcción del deber ser/hacer/decir social femenino o masculino y proceso de enseñanza-aprendizaje del derecho penal. Dentro de las conclusiones, las mujeres ante la sociedad aún tiene una brecha muy grande por los patrones machistas y patriarcales que se muestran en las instituciones educativas y laborales, demostrando la violencia simbólica en las acciones sociales, culturales y educativas hacia las mujeres.
It makes visible the symbolic violence exerted on the female gender, based on the study of authority and gender relations that is achieved in the teaching-learning process of Criminal Law at the Law School of the University of Costa Rica. Within the specific objectives: to demonstrate the influence and permanence of the patriarchal andrologocentric system in the teaching of Criminal Law, to point out the stereotypes of the feminine "must be / do", found in the social dispositions accepted among students and teachers, and to identify the Manifestations, expressions and forms of symbolic violence against the female gender in relations between teachers and students of the teaching of Criminal Law. The research methodology has a qualitative and gender focus. The in-depth interview technique was used, and the research subjects are teachers and students who teach or receive the Criminal Law course. Among them, six professors and eight law students were interviewed. In the analysis of the data, the process of the referential axes was used, composed of: keywords as indicators and three main contexts, which are: criminal law in Costa Rican society, construction of the social feminine duty / do / say or male and the teaching-learning process of criminal law. Within the conclusions, women in society still have a very large gap due to the macho and patriarchal patterns that are shown in educational and labor institutions, demonstrating symbolic violence in social, cultural and educational actions towards women.
