Reflexiones: La competencia no funciona por decreto

He venido viendo como algunos abogados e ingenieros poco formados en economía abordan el tema de la competencia y la regulación de los mercados en Costa Rica. Es evidente que la competencia, en mercados estrechos y pequeños como los centroamericanos, no funciona por decreto. No por el hecho de liberalizar, soltar o dejar a la libre un mercado en su funcionamiento, tenemos como resultado más o mejor competencia en el mercado. Muchas veces los mercados tienden por su propia naturaleza, estructura o arquitectura institucional, a ser poco o no competidos. La colusión, concentración y grado de competencia de los mercados dependen en mucho del tamaño, participación del mercado, rivalidad existente, control o no de materias primas, así como, de aspectos claves de la cadena de valor y de la dominancia existente. Es poco lo que se puede hacer mediante decretos o leyes de competencia para corregir fallas de mercado evidentes que inhiben la competencia en el mercado.
I have seen how some lawyers and engineers with little training in economics address the issue of competition and the regulation of markets in Costa Rica. It is clear that competition, in narrow and small markets such as Central America, does not work by decree. It is not by liberalising, releasing or leaving a functioning market to the free that we result in more or better competition in the market. Markets often tend by their very nature, structure or institutional architecture to be non-competitive or uncompetitive. The collusion, concentration and degree of competition of the markets depend largely on the size, market share, existing rivalry, control or not of raw materials, as well as on key aspects of the value chain and existing dominance. Little can be done through decrees or competition laws to correct obvious market failures that inhibit competition in the market.
