Resumen
El derecho al trabajo es un derecho humano, sin embargo, los avances tecnológicos, cambios a lo interno y externo de las organizaciones, han generado variaciones en los procesos, metodologías, políticas, procedimientos, actividades y perspectiva en que las empresas han asignado responsabilidades y funciones a sus colaboradores; lo que ha influido en la dinámica de la relación laboral entre patronos y colaboradores; donde los derechos individuales de estos últimos no fueran violentados. Este artículo presentó la visión de los derechos actuales de los trabajadores, resultado de una revisión crítica de la literatura sobre la diferencia entre el derecho de intimidad y privacidad de los colaboradores, el control adecuado que deben llevar a cabo los líderes de las empresas, las implicaciones jurídicas y administrativas en la gestión del talento humano. Así como una vista, de la forma en que los derechos de los colaboradores han sido vulnerados por el empleo de medios fiscalización no adecuados en una relación laboral. Para concluir con acciones a implementar en la relación laboral y la protección del derecho a la intimidad de los colaboradores.
The right to work is a human right; nevertheless, the technological advances and the internal and external changes in businesses have produced variations in the processes, methodologies, policies, procedures, activities and perspectives in which companies have assigned responsibilities and roles to their workers. This situation has influenced the working relationship between employers and employees to avoid the individual rights of the latter being violated. This article shows a perspective of the employees current rights as a result of an objective literature review about the difference between the right to intimacy and to privacy of the company’s collaborators, the adequate control that the company leaders must carry out, and the legal and administrative implications in the management of human talent; as well as, the way in which workers’ rights have been violated by the use of inappropriate control mechanisms and the actions to be performed to protect the collaborators right to privacy
