Resumen
Los derechos de propiedad intelectual y sus repercusiones sobre el ambiente han estado presentes en las agendas de las negociaciones de tratados de libre comercio y de algunos acuerdos ambientales desde hace varios años. El Area de Libre Comercio de las Américas (ALCA) no constituye una excepción. Por ello, el presente documento analiza las implicaciones y consideraciones de carácter ambiental que deben de ser tomadas en cuenta en el marco del Grupo de Negociación sobre Propiedad Intelectual. Para tal efecto, luego de una explicación de los conceptos básicos sobre los derechos de propiedad intelectual, se estudian algunos de los acuerdos comerciales que han incorporado este tópico en el texto del Tratado. Igualmente se revisan los regímenes multilaterales, como la Convención sobre la Diversidad Biológica y el Compromiso Internacional sobre los Recursos Fitogenéticos de la FAO en tanto aportan elementos para delinear la relación entre propiedad intelectual y ambiente. Posteriormente, se presenta un análisis pormenorizado de los principales puntos de conexión entre ellos. Por último, se sugiere un conjunto de recomendaciones de cara al proceso del ALCA.
The rights of intellectual property and their repercussions on the environment have been present in the agendas of the negotiations of Free Trade Agreements and in some environmental agreements for several years. The Free Commerce Area of Americas (ALCA, Spanish acronyms) does not constitute an exception. For that reason, the present document analyzes the implications and considerations of environmental character that must be taking into account in the Group of Negotiation on Intellectual Property framework. For such effect, after an explanation of the basic concepts on the rights of intellectual property, some of the commercial agreements that have been incorporated this topic in the text of the Treaty is going to be analyzed. Also the multilateral regimes are reviewed, as the Convention on the Biological Diversity and the International Commitment on Fitogenetic Resources of the FAO because they give elements to delineate the relation between intellectual property and environment. Later, a detailed analysis of the main points of connection among them appears. Finally, a set of recommendations facing the process of the ALCA is suggested
